Car Accident with Uninsured Motorist?

It is a common belief that if you have a road traffic accident with an uninsured driver and it wasn’t your fault, there isn’t anything that can be done. This is not the case.

If you have at least third party motor insurance cover, you may still be able to make a no win no fee claim for compensation.

What to do if you are in an accident with an uninsured motorist?

Firstly report the incident to the police. Following this you will need to establish contact with the Motor Insurers’ Bureau (‘MIB’) (an independent organisation funded by the insurance industry).

Unfortunately this can be quite a complex process and it is adviseable to use a law firm, like us, that specialises in making claims to the MIB.

The MIB will investigate the accident and if the driver is traced and it is proved that you were not at fault, the MIB may pay for damage to your car (after you have paid £300 excess for any repairs) in addition to compensation that you deserve for your injuries. If the driver cannot be traced you should still be able to claim for personal injury compensation, but not for damage to your vehicle.

There is no financial limit on personal injury payouts from the MIB and each case is dealt with individually.
